Poland’s legal provisions relating to infectious diseases and epidemics: an assessment of the current legal status

Abstract

This article is an attempt to answer the question whether Poland’s legal provisions relating to infectious diseases and epidemics ensure safe conditions for individuals in the event of a health risk due to an infectious disease or epidemic. It also asks whether these regulations comply with the provisions of the Constitution of the Republic of Poland and the principles of legislative technique, and reviews the relevant legislation, jurisprudence and doctrine to answer these questions. The results of this study show that the Polish legal regulations relating to infectious diseases and epidemics provide individuals only with partial security against health risks from infectious diseases and epidemics. The legislation regarding restrictions, orders and bans enforced on individuals in connection with the outbreak of an epidemic and order of access to COVID-19 vaccination was not issued in accordance with the principles of legislation as defined in the Constitution of the Republic of Poland and legislative technique.
