Administrative operations at a time of crisis: remarks on administration during the pandemic

Abstract

This article is a contribution to the discussion on admissible forms of administrative operations and limits to administrative interference in an individual’s personal, political and economic freedom in crisis situations. It looks at the controversial provisions introduced in Poland regarding forms of administrative operations applicable during the COVID-19 pandemic from March 2020 until June 2023, prescribed under Ustawa z 5 grudnia 2008 r. o zapobieganiu oraz zwalczaniu zakażeń i chorób zakaźnych u ludzi (the Prevention and Containment of Infectious Diseases in Humans Act of 5 December 2008) and the Council of Ministers’ ordinances issued on the grounds of this Act. The aim of the study is to assess these regulations and consider the changes which should be made to improve the situation and achieve the best possible compromise between administrative effectiveness in crisis situations and the protection of fundamental human and citizen’s rights and values.
