Property owners’ share in the costs of construction of technology infrastructure financed from public funds: current problems

Abstract

The value of a property depends on many factors. The construction of technology infrastructure or of a road undoubtedly affects the attractiveness of the property and its value. A contribution from public funds to the installation of such facilities or the construction of a road is an appreciable benefit for property owners. The Polish legislator has created an instrument in the form of a betterment levy, which the local authority involved may charge for such services and which expresses the contribution property owners make to the costs of installing technology infrastructure. This article discusses the legal grounds, especially as regards substantive law, which entitle a local authority to charge a betterment levy. This kind of betterment levy has been giving rise to controversy, despite the statutory grounds for charging it, which in practice means that there have been serious problems calling for clarification with the interpretation of the regulation.
