The term “maintenance obligation” in Council Regulation (EC) No 4/2009 and its interpretation in the case law of the Court of Justice of the European Union

Abstract

The migration of citizens of European Union countries has significant social implications, resulting in rising numbers of cross-border cases relating to family matters, in particular maintenance. The applicable legal instrument in such issues is Council Regulation (EC) No 4/2009 of 18 December 2008 on the jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations. This article examines the problem of defining the term „maintenance obligation,” including the need for its broad understanding, as well as its interpretation in the case law of the Court of Justice of the European Union.
