Unfair practices by renewable energy prosumers from a public law perspective

Abstract

Inspections carried out in Poland on the premises of renewable energy prosumers have revealed a number of irregularities. This article reviews the findings from the perspective of public law. Under Polish law, a prosumer who wilfully raises the power of the electrical device installed on his premises may be committing an administrative tort, a minor offence, and/or embarking on a certain stage of fraud. If he modifies the inverter settings, as a rule he will not be liable to prosecution under Polish public law. However, if he removes the lock on the electric meter box without the consent of the operator, he will be committing a minor offence. If he tampers with and makes unlawful changes to the metering system, he may be liable for committing a certain stage of fraud.
