Stay of enforcement of a dismissal order from the Polish Police Force: selected issues

Abstract

This article concerns the stay of enforcement of an order for a police officer’s dismissal from the Polish Police Force. The entity which issued the contested dismissal order as well as the applicable administrative court has the authority to stay the procedure. Both the dismissing entity and the administrative court have a specified time limit to exercise these powers, following the emergence of a specific set of premises required for the implementation of the said powers. This legal instrument is available once a valid complaint has been submitted to the appellate authority, which may stay the enforcement order only if it has not been carried out by the day on which the appeal is considered.
