The Polish Hunting Association (Polski Związek Łowiecki) is an organization in the association category. It has a membership of natural and legal persons and operates on the grounds of Polish statutory law (the act of legislation regulating its activities) and its Statute adopted by the National Congress of the Association’s Delegates. It has a legal personality. The Polish Hunting Association manages hunting activities by breeding and animal harvesting and works to protect the resources of game by regulating the size of the game animal population. The scope of activities pursued by entities of the Polish Hunting Association is determined by the regulating Act and the Statute adopted by its National Congress of Delegates. One of the ways the national authorities of the Polish Hunting Association exercise their powers is by passing resolutions subject to supervision by the Minister for the Environment. The criterion for the acceptance of such resolutions is that they
must comply with the law. In the event of a violation of the Association’s Statute, the supervisory authority may repeal the resolution in whole or in part, and in the event of a violation of the generally applicable legal order, it may declare the resolution invalid in part or in whole. The supervisory authority exercises its monitoring powers by issuing an administrative decision (order) which is subject to verification in the event of the Association applying for a reconsideration of the case or, alternatively, by filing a complaint (appealing) to the administrative court against a non-final order. The aim of this article is to present and discuss issues concerning the exercise of supervision over the resolutions passed by the national authorities of the Polish Hunting Association, and of the way the Supervisory Authority (the Minister) issues its orders subject to review (appeal) on application by the Association.
