The EU Resettlement and Humanitarian Admission Framework from the perspective of the principle of responsibility sharing in international refugee protection

Abstract

Over the past decade, EU Member States have faced several serious crises. One of them was the migration and refugee crisis, which has been the largest humanitarian crisis in Europe since the end of World War II, and its effects are still being felt today. It also revealed numerous shortcomings in the global system of international protection for refugees. One of these defects is the lack of an effective mechanism for distributing the burden and responsibility for refugees between the countries concerned. EU Member States are lagging behind in terms of the number of resettlement places offered to refugees. Although the Common European Asylum System contains a catalogue of procedural and substantive rights for persons seeking international protection, resettlement has taken place in a legal vacuum due to its largely discretionary and voluntary nature. This situation is due to changes under EU regulations that establish an EU framework for the resettlement and reception of refugees in emergency situations. The regulation is one of the legal instruments of the 2024 Pact on Migration and Asylum. This article aims to determine whether the new regulation considers the mechanism for a fair distribution of the burden and responsibility for refugees between countries, particularly the relief of the poorest and most burdened countries. Thus, the question is whether the new regulation complies with the humanitarian nature of resettlement or pursues a pragmatic approach to strengthen and control the external borders of “Fortress Europe,” thereby maintaining the traditional voluntary and discretionary nature of Member States’ actions in this area.
