The defectiveness of Polish bylaws as exemplified by resolutions on childcare subsidies

Abstract

An examination of bylaws issued by Polish local authorities on childcare subsidies for children under 3 years shows that under review such bylaws frequently turn out to be defective and fall short of legislative standards. The main reason for this is the overgeneralized nature of delegated legislation created by Polish local authorities, which fosters too broad an interpretation of the principles for the evaluation of childcare subsidies. In consideration of the limited legislative freedom Polish local authorities enjoy for the enactment of bylaws, my advice to them is to keep strictly within the statutory bounds of their legislative powers. The bylaws they adopt should meet all the statutory requirements for delegated legislation.
