Abstract

The second edition of the Polish translation of Gustav Radbruch’s monograph Einführung in die Rechtswissenschaf was published in 2024 and provides an opportunity for a re-examination of Radbruch’s “positivist” view of Roman law. There are good grounds for this, since Radbruch refers to ius Romanum on several occasions. He is hardly a partisan of Roman law and shows his aversion especially to the legacy of the Savigny school of history, but also recognizes the merits of ancient solutions in the formation of modern German law. The clarity and originality of his views should make his book a particularly interesting publication for Polish scholars of Roman law.
