Counsel for the defense in mediation proceedings

Abstract

The specificity of mediation arises from the fact that it is an extrajudicial proceeding which is part of the criminal process. Mediation is conducted between the victim and the perpetrator of the offense, which influences its course and the effects that can be obtained in the proceedings. This also makes the role of the participants contributing to mediation specific, which applies primarily to the defense counsel, who plays an extremely important role in criminal proceedings. The defense counsel in criminal proceedings acts in the broadly understood interest of the defendant and the only actions he may take must be to the defendant’s advantage. However, no scholarship has been done to date to specify the role of the defense counsel in mediation proceedings, what actions he or she should take and to what extent he or she can support the defendant during a mediation meeting. The aim of this article is to determine the role of the defense counsel in mediation proceedings.
