The Status of Judges in the French Commercial Tribunals in the Light of the Amended Provisions of the French Commercial Code

Abstract

The French Commercial Code is an important element of French law that dates back to the early nineteenth century. A crucial aspect of this codification was the establishment of tribunaux de commerce (commercial tribunals) as one of the elements of the system of specialized frst-instance jurisdiction. The way such a court operates is associated with the status of its judges. The aim of this study is to examine the changes that have occurred in this regard under the latest reform of 2023, in order to verify the claim that the new regulations have been customized to meet contemporary challenges, both in terms of legal security and the digitization of business affairs. Previous studies on the history or organization of the work of French commercial tribunals have given cursory treatment to the status of their judges, not to mention the analysis of recent developments in this area. Therefore, this publication may constitute a comparative legal contribution to a broader discussion of the validity of having a separate specialized court system. Due to its specific nature and historical conditions, the French legal system may also provide an interesting source of inspiration for the Polish legislator.
