Skipping an Instance: A Proposal to Bring a Leapfrog Appeal System into Polish Administrative Court Proceedings

Abstract

This article takes a comparative law approach to examine analogous situations in the Polish and German legal orders, and proposes the introduction of a leapfrog appeal system in Polish law similar to the German Sprungrevision scheme. This would be admissible from the point of view of constitutionality and it would also be a good and practical solution without the need for considerable amendments. The first part of the article examines the German regulation, whereby the Sprungrevision allows litigants to bypass the appellate instance of the administrative court and bring a revision directly from a first-instance judgment to the highest instance, which significantly shortens administrative proceedings. The second part of the article presents a postulate for the introduction of a similar institution in Polish law, whereby in certain cases of key legal significance, once they passed the first-instance stage, it would be possible to skip the voivodship administrative courts and refer the case directly to the Supreme Administrative Court. Such a solution would not be in breach of the Polish Constitution.
