On Decisions and Other Operations on the Example of (In)appropriate References in the Polish Veterinary Facilities Act

Abstract

This article presents some unwanted consequences of the Polish legislator’s use of references in the texts of normative acts. It uses Ustawa z dnia 18 grudnia 2003 r. o zakładach leczniczych dla zwierząt (the Veterinary Facilities Act of 18 December 2003) as an example to show how administrative court rulings interpret the system of references in this act as a restrictive measure on business activities. This in turn called for an examination of the form in which decisions are made by regional veterinary chambers. In the context of this legal problem, the article presents a test to determine the diﬀerences between administrative acts that are decisions and other acts referred to in Section 3 §2 Point 4 of Ustawa – Prawo o postępowaniu przed sądami administracyjnymi (the Act on Proceedings before Polish Administrative Courts).
