The Law on the Protection of Personality Rights in Poland’s Bilateral International Treaties

Abstract

The Polish domestic law on the protection of personality rights is regulated by Ustawa – Prawo prywatne międzynarodowe (the Private International Law Act). However, in international relations priority is given to Poland’s bilateral international treaties. Personality rights are protected under the conflict of law rules for non-contractual obligations defined in these treaties. Their content differs significantly from the regulations in the Polish domestic conflict of law act for the protection of personality rights. Identifying situations in which bilateral treaties should be applied may cause difficulties, which entails uncertainty as to which law is applicable.
