The Evolution of Pharmacists’ Professional Responsibility: Principles and Basic Description

Abstract

The professional responsibility of pharmacists is regulated in Poland by Ustawa z dnia 19 kwietnia 1991 r. o izbach aptekarskich (the Pharmaceutical Chambers Act of 19 April 1991), the Polish Pharmacist’s Code of Ethics, and Rozporządzenie Ministra Zdrowia z dnia 31 marca 2003 r. w sprawie postępowania w sprawach odpowiedzialności zawodowej farmaceutów (the Minister of Health’s Regulation of 31 March 2003 on Proceedings Pertaining to the Professional Responsibility of Pharmacists). In the 1991 Act the legislator defined the role and tasks of self-governing chambers of pharmacists. Hence we may say that their main aim is to represent the pharmacist’s profession, to defend the interests of pharmacists, and to uphold the dignity and independence of the profession. Proceedings pertaining to the professional responsibility of pharmacists differ significantly from proceedings concerning the professional responsibility of physicians, nurses, or midwives. These differences may be observed both in the structure of the proceedings and in the list of penalties. Although the differences have an obvious effect on the nature of the proceedings, yet the prerequisites for holding someone professionally liable are identical. They always involve infringement of the rules of professional ethics and of the regulations relating to professional practice.
