The Employer’s Duties Regarding the Health and Safety of Home-Based Teleworkers

Abstract

The article focuses on the Polish legal regulations regarding the employer’s obligation to ensure the health and safety of home-based telework. If the teleworker is working from home, the employer must perform the duties specifed in the Polish Labour Code with respect to the teleworker, regarding the type and conditions of the work performed, except those defined in Art. 6717. This exclusion is considered quite narrow, which may be the reason why in practice employers are not very interested in this form of work. Te implementation of the obligations stipulated in the Labour Code in the area of health and safety will not be easy, due to the requirement that teleworker’s privacy must be observed. Telework makes for difficulties for employers and Państwowa Inspekcja Pracy (Poland’s National Labour Inspectorate) in the supervision of teleworkers’ working conditions. The aim of this study is to present the main problems in this subject.
