Consular Proxy Marriage Contracted by Polish Citizens

Abstract

Polish law provides for two forms of consular marriage, contracted before a Polish consul officiating in a foreign country (Article 1 § 4 of the k. r. o. [Polish Code of Family Law]), and by proxy (Article 6 of the k. r. o.). While the legislator gives a fairly clear separate description of each of these methods of contracting marriage, questions and dubieties still to be resolved appear as soon as the two forms are looked at together. The very first of these questions is whether it is admissible for Polish citizens to enter into consular proxy marriage, and if so, are the provisions regulating these formulas “mutually recognised” and synchronized? The article is an attempt to answer these questions.
