A Policeman’s Secondment for Duty in a Domestic Institution outside the Police Force as a Way to Transform His Professional Status

Abstract

In Poland the secondment of a policeman for duty outside the Police Force is regulated by provisions which have been added to the 1990 Police Act (Ustawa o Policji z 6 kwietnia 1990 r) relatively recently. The application of the provisions on a policeman’s secondment effect a change in his professional status, changing the public administration entity in which he is to perform his official duties. However, secondment to a domestic institution (i.e. one operating on the territory of the Republic of Poland) does not constitute a subjective transformation of a policeman’s professional status. He will still be in the service of the Polish State both before and afer the secondment. Neither will his service, which is the subject of his professional status and is regulated by Polish administrative law, change to work performed on the grounds of an employment contract, which is subject to Polish labour law.
