‘Quaestor populi Romani ad praetorem in ius vocari posset?’ A Few Remarks on Gell. 13,3

Abstract

This article focuses on the praetor’s performance of in ius vocatio in proceedings against a quaestor. I examine a passage from Aulus Gellius’ Attic Nights, in which he says that Roman jurisprudence was particularly interested in cases involving the prosecution of a quaestor, not only theoretically, but also from the practical aspect.

My study shows that the rule established in the Republican period whereby minor magistrates did not enjoy legal immunity was still applicable in Gellius’ times (the 2nd century AD).
