Dismissal of a Party’s Evidentiary Motion Submitted after the Deadline set by the Judicial Body: Remarks on Art. 170 § 1. 6 and § 1a of the Polish Code of Criminal Procedure

Abstract

This article discusses the grounds for the dismissal of a party’s evidentiary motion in criminal proceedings, as defined in Art. 170 § 1 point 6 of Kodeks postępowania karnego (the Polish Code of Criminal Procedure) and brought into the Code by the amendment of 19 July 2019 (Ustawa z 19 lipca 2019 r. o zmianie ustawy – Kodeks postępowania karnego oraz niektórych innych ustaw; Dz.U. 2019, Item 1694). Under the amended article, an evidentiary motion may be dismissed also if it was submitted after the deadline set by the judicial body, of which the party submitting the motion was notified. The present study also considers the disposition of the amended Art. 170 § 1a, which offers the possibility of an evidentiary motion being dismissed if it was submitted after the deadline set by the judicial body, in a situation where it concerns the key circumstances from the point of view of the decision on criminal liability. I present the ratio legis for the amendment of Art. 170 § 1 point 6 and § 1a, and give a dogmatic analysis of these provisions as well as their assessment from the point of view of the axiology of criminal proceedings. I compare the new regulations with the set of key procedural principles currently in force, and offer a practicable interpretation of the new provisions.
