The Civil Aspects of International Child Abduction within the European Union

Abstract

International parental child abduction is regulated primarily in the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction. Within the European Union its operation has been supplemented and modifed by some provisions of the Council Regulation (EC) No 2201/2004 of 27 November 2003 Concerning Jurisdiction   and the Recognition and Enforcement of Judgements in Matrimonial Matters and the Matters of Parental Responsibility repealing Regulation (EC) No 1347/2000 (the Brussels II Bis Regulation). This article analyses the key provisions of this regulation and their implications relating to child abduction cases in Poland.
