Normal Use of a Work Subject to Copyright and its Creator’s Legitimate Interest as Restrictions for Permitted Use in Copyright Law

Abstract

The permitted use of works subject to copyright make up a catalogue of provisions defining the conditions under which copyrighted works protected by an author’s proprietary rights may be used without the consent of the authorised entities. One of the restrictions on their use is a ban on violations of the normal use of the work or harm to the legitimate interests of its creator. The regulation which was transposed several years ago from international law into the Polish act on copyright and related rights and which is known as the three-step test, uses vague terms that raise doubts due to the heterogeneous positions of the doctrine and the lack of clear guidelines from the case-law, including the case-law of the EU Court of Justice. What makes the issues involved all the more topical is the fact that these provisions are used to assess the admissibility of individual cases of the use of copyrighted works, while nowadays new technologies are having an impact on the way users interpret copyrighted works.
