The Transfer of Executive Power in the USA

Abstract

The aim of this article is to present the mechanisms and procedures used in the transfer of executive power in the USA. From the legal point of view, this process is particularly interesting when it occurs as a result of a presidential election, which is held every four years. The issues involved have been fairly precisely defined in US federal regulations adopted decades ago and amended many times, but there are also various kinds of imponderables which play a substantial role in the efficient transfer of power. This article also aims to show that the effectiveness of the mechanisms prescribed in federal law and the customs that have been observed for decades largely depends on the attitude and conduct of the outgoing president.
