Current Jurisprudence in Poland Regarding the Liability of the Institutions of the Roman Catholic Church for Crimes of Paedophilia Committed by its Clergy and Consecrated Persons

Abstract

The aim of this paper is to examine the operative parts of selected judgements issued by Polish courts in cases brought by victims of paedophilia against the institutions of the Roman Catholic Church with which the offenders were officially associated. In line with the conceptual assumptions of this paper, the analysis of these judgements was made on the basis of criteria which from the theoretical point of view allow for the formulation of the general principles guiding courts in such cases. At the same time, this study of Polish jurisprudence has brought several practical suggestions which may be useful in handling cases against Polish religious institutions with a confirmed legal status.
