Critical Remarks on a New Preventive Measure Provided for in Art. 276a of the Polish Code of Criminal Procedure

Abstract

This article discusses a new preventive measure the Polish legislator has introduced for criminal proceedings on the grounds of the recently adopted anti-covid act. It presents an extensive analysis of Art. 276a of the Polish Code of Criminal Procedure in the context of the victim’s status in criminal proceedings. Te recently introduced preventive measure is a novelty to current Polish criminal procedure, and its application, the assessment of its impact on the concept of preventive measures envisaged in the Code, and its relation to other preventive measures not involving loss of liberty have so far not been examined to any great extent. Over the last decade or so, the general tendency in Polish legislation has been to strengthen the victim’s position in criminal proceedings. The establishment of a non-custodial measure which makes a specific social group its beneficiary undoubtedly marks a new trend in Polish criminal procedure.
