What’s good for businessmen and what needs to change: on hopes for insurance law

Abstract

This article analyzes the status and significance of insurance in socio-economic affairs, with particular attention to the needs of businessmen. It looks at the consequences of the current regulation of the definition of an insurance contract under Article 805 of the Polish Civil Code, and emphasizes that this regulation cannot be interpreted unless public law is taken into account, above all, the Polish Insurance and Reinsurance Act and Insurance Distribution Act. The article lists the benefits to which a businessman is entitled under an insurance contract, and in its conclusion postulates what still has to be done to remedy the shortcomings of the current Polish legislation on insurance.
