Abstract

Summary

This article discusses the core issues relating to the Dodd-Frank Act of 2010, which was passed to ensure the stability of the financial sector in the United States. Special attention is paid to two new legal mechanisms. Te first relates to the rules and procedures under which the Financial Stability Oversight Council (FSOC) may consider a non-banking finance company important for the stability of the US financial sector. In such a situation the US Central Bank may initiate “supplementary supervision.” The second mechanism involves the controlled liquidation procedure of a financial company which the FSOC considers could disturb the stability of the US financial system.
