Roman Law in the Jurisdiction of the Supreme Court of the United States of America

Abstract

Summary

The Supreme Court of the United States of America has frequently referred to Roman law in the grounds for the verdicts and rulings it has handed down. Most of its references to Roman law have occurred in a historical context, for the clarification of complex issues, when it has presented the history of a particular legal institution, going back to its ancient origins. Thereby the judge compiling the grounds for the Court’s verdict endeavoured to show that he had conducted a comprehensive and in-depth examination of the question, going right back to the given institution’s ancient roots. Most frequently he would cite a particular Roman law source by quoting the original phrases or even the whole text in Latin, or sometimes by giving just a reference to the source. Some of the most frequent references have been to Gaius and Justinian (the Code and the Digests), and somewhat less often to Teodosius. In this article I look at rulings delivered by the American Supreme Court since 1819, as part of an ongoing discussion of how Roman law has influenced the common law systems.
