Abstract

Summary

The aim of this article is to present key issues relating to the correct interpretation of Articles 28 and 28a of the Polish compulsory insurance act, and to present postulates for their amendment. These provisions regulate very important questions concerning the ex lege prolongation of compulsory motor insurance and double insurance contracts. The first part of the article clarifies certain terminological issues. Next the authors analyse the statutory prolongation clause and the related right to terminate an insurance contract, as well as the insurance company’s duty to inform the holder of the contract of its decision. The article’s second part is on the new arrangements for the issue of double (multiple) insurance in force since February 2012. The authors present a number of problems relating to the interpretation and application of Art. 28a. Finally, in the summary, they present some changes which could be brought into these regulations.
