Douglas Husak’s Opinion on the Decrimilisation of Drug Possession and Use: The Polish Perspective

Abstract

This paper presents Douglas Husak’s theory of criminalisation, which claims to be the normative standard for the construction of criminal regulations. I examine Professor Husak’s work in scholarship and journalism to show the practical application of his theory as regards the prohibition on drug possession and use. In the second part of the paper I present the Polish legal doctrine on the theory of criminalisation and compare it to Husak’s theory. My article concludes with an analysis of the judgment handed down by the Polish Constitutional Tribunal, in which the Constitutional Court expressed its position on the criminalisation of the possession and cultivation of marihuana, which I discuss in the light of Husak’s postulates on this issue.
