The Origins of ‘adrogatio impuberis’ in Roman Law

Abstract

It is generally held that the institution of adrogatio impuberis was not admitted until the legislation of Antoninus Pius. On the basis of the sources, the Author tries to prove that such a procedure was already legally possible in the times of Claudius (and more precisely as of 50 AD), although in practice it was discontinued later because of the negative assessment of the effects of such adoptions. Te crucial evidence confrming such a possibility is provided by an ambiguous passage in Gaius’ Institutes (Gai. 1,102), in which the word nunc may be alternatively read as nam.
