The Limited Company as a Victim in Criminal Proceeding: Selected Issues

Abstract

The article discusses the situation of the limited company which is the victim in criminal proceedings where the offence against the company has been committed by its sole shareholder, the only member of its board of managers. I present issues related to the concept of the injured party from the point of view of criminal procedural and substantive law, and regulations associated with legal representation in the situation where it is necessary to exclude a company entity on the grounds of commercial law and civil proceedings. I conclude my observations with a presentation of my own position and postulates for new legislation.
