On Legal Principles in Roman Egypt or how a Principle is Born

Abstract

Legal rules, their origins, scope, and application have always been a popular subject for scholarly research, and in particular among the greatest of Romanists. In the recent times they have attracted even more attention. This new popularity is due to the perennial quest for the purpose of our discipline. In the 21st century regulae iuris, elegantly formulated in Latin (even if worded in the way the Romans themselves never knew) seem to breathe a new meaning of life to Roman law. It becomes thus a resource of universally binding and readily comprehensible norms, voiced in an attractive form. These catchy lines, ready to be used in the everyday legal discourse, prove yet again how useful and important we the Romanists are for the modern lawyers. In my paper I intend to examine how these rules may have actually emerged, since they have oftentimes come down to our times devoid of their original context. By studying court records from Roman Egypt (minutes, judgements, judicial decisions handed down by judges of various ranks, and petitions submitted by parties) I trace down the possible way in which the rules may have been created. Tis class of documents often includes clauses intended to transmit the legal standing of the cases. They sometimes invoke the nomoi (statutes), and earlier judicial decisions, both cited in an abbreviated, laconic, and almost epigrammatic form. Parties availed themselves of these “legal rules” in an attempt to bind the judicial authority.. My aim is to present the use and abuse of such practices, in particular analysing P Oxy II 237, P Oxy XLII 3015, and SB XIV 12139.
