PROHIBITION OF ‘REFORMATIO IN PEIUS’ IN POLISH CIVIL PROCEDURE IN THE LIGHT OF THE TRADITION OF ROMAN LAW
Summary
The subject of this paper is an assessment of the influence of Roman law on the contemporary regulations for appeal in Polish civil procedurę as regards the prohibition of reformatio in peius. The author’s analysis shows that despite the general belief that the ban on the worsening of the appellant’s situation in the event of the opposite party failing to lodge an appeal derives from Roman roots, in fact when used in the context of the way in which Polish appeal courts deliver a verdict, the expression reformatio in peius is nothing more than an artificial legal concept derived from Latin.
