Abstract

This article examines the significance of conscientious objection in the context of the political philosophy of Ernst-Wolfgang Böckenförde, a German jurist and philosopher. To this end, we outline his views on topics such as the emergence of the modern state as part of the process of secularisation, the dialectic of power and freedom, and the necessity of a relative homogeneity in a pluralistic society. Böckenförde’s work articulates the concept of conscientious objection as an essential element of a democratic state under the rule of law, relating it to constitutional freedom of conscience.
